Laws for immigrants married to Korean nationals

The National Basic Life Security Law

Clause 2 of Article 5 (Special provisions for foreigners): Basic life security support shall be given to a foreigner who is married to a Korean national, resides in Korea, has dependent children with Korean nationality and at the same time corresponds both to the conditions decided by presidential decree and to Article 5 (Recipients).

One Parent Family Support Law

Article 10 (Special provisions for foreigners): One Parent Family Support Law (Hereinafter referred to as "Law"). In accordance with the 3rd paragraph of Clause 2 of Article 5, those who are subject to special support refers to a foreigner who is married to a Korean national, resides in Korea, has children with Korean nationality and is registered as a foreigner according to Article 31 of the [Immigration Law].

Emergency livelihood support Law

This law is designed to support those who are in an urgent situation in continuing livelihood in an effective manner and to help them enjoy a healthy life with dignity.
Article 5 (Those eligible for emergency support): Those who are eligible for emergency support (Hereinafter referred to as "Emergency recipient") include a person having serious difficulties in maintaining his or her livelihood and who urgently need the emergency support described in this law.

National Health Insurance Act

This Act is enacted to promote the health of all citizens and improve the social insurance system by providing insurance benefits in such cases as diagnosis, prevention, treatment of diseases and injuries, childbirth, death and improvement of health.
Article 93 (Special provisions for foreigners): Overseas Korean who are currently living in Korea or foreigners who are eligible for the benefit by presidential decree may become a recipient of or subscriber to this insurance despite the provisions in Article 5.

  • Health Insurance of foreign immigrants who are married to a Korean national :
    Foreign immigrants who are married to a Korean national can apply for this insurance with a copy of their alien registration card and family relation certificate after registering their marriage.

Requirements and necessary documents for acquiring Korean nationality

Requirements (Basic naturalization)
  • Those who are married to a Korean national and have had their address in Korea for more than 2 years after the marriage (Item 1).
  • Those who have been married to a Korean national for more than 3 years and have had their address in Korea for more than 1 year after the marriage (Item 2).
  • Those who are not subject to Item 1 and 2 above but have been unable to maintain normal marriage status for such reasons as the death of or the missing of one's spouse or any other reasons that are not attributable to one's own act and how have been recognized by the Minister of Law to have filled the period stipulated in Items 1 and 2.
  • Those who are not subject to Items 1 and 2 above but who are raising or are responsible for raising children by a Korean spouse and who have been recognized by the Minister of Law to have filled the period stipulated in Items 1 and 2.

  • Application form for naturalization, marriage certificate, certificate of the facts concerning the entry & exit, a copy of passport and alien registration card, a copy of the spouse's family registration and resident registration, statement of identity.
